Transport Licence

Section 9 Para. 4 of Act No. 263/2016 Coll. a Section 4 of Decree No. 379/2016 Coll.
is required for a transport of:   

  • fissile material if the sum of the criticality safety indices of packages in one conveyance or shipping container is greater than 50;
  • nuclear fuel;
  • a package containing special form radioactive material with activity greater than 3000 A1, radioactive material other than special form with activity greater than 3000 A2 or radioactive material with activity greater than 1 000 TBq, depending on which of these values is lower;
  • radioactive or fissile material in packaging of Type B(M) that is not designed for a temperature range of minus 40 ºC to plus 70 ºC or that is designed to permit occasional controlled ventilation;   
  • radioactive or fissile material via a vessel intended for this purpose with a specified radiation protection programme;
  • radioactive or fissile material containing radionuclides whose values of A1 and A2 not listed in Table 2 of Annex 3 to Decree No. 379/2016 Coll. were stipulated by calculation pursuant to Points 3 to 7 of Annex 3 to Decree No. 379/2016 Coll.; 
  • radioactive or fissile material contained in an instrument or product and containing radionuclides whose values for a package exception listed in column 5 of Table 2 of Annex 3 to Decree No. 379/2016 Coll.were replaced by values calculated according to principles and methods stipulated in Annex 6 to Decree No. 379/2016 Coll.; 
  • fissile substances pursuant to Point 17(f) of Annex 3 to Decree No. 379/2016 Coll.

Licensing Conditions

SÚJB issues the licence for a transport only if following approvals have been already issued:         

  • type approval of a packaging for the transport of radioactive or fissile material,
  • approval of the physical protection assurance plan for the transport of nuclear materials of categories I to III,
  • approval of emergency regulations for particular transport. 

 The applicant may ask for the issue of all above listed approvals in one application. 

Licence Application - Content

Section 16 of Act No. 263/2016 Coll.  

  • the subject, scope and periods of transport(s) to be licensed,
  • applicant's identification (name, address, ...),
  • personal number, if assigned, name at birth, if different from current name, and the place and district of birth of the natural person who is  the applicant, a member of a statutory body of an applicant who is a legal person, or an alternate of a legal person, which is a member of a statutory body of an applicant who is a legal person 
  • a document certifying the professional competence for the activity to be licensed in case of a natural person or, where the applicant is a legal person, proof of professional competence for the activity to be licensed of at least one member of the statutory body,
  • the registration number of licensee granted by the office, if already assigned,
  • the required documentation for the activity to be licensed; ie. safety case according to the Annex 1 of Act No. 263/2016 Coll., Part 4 (Carriage of radioactive or fissile materials),
  • a certificate of nuclear damage liability insurance or evidence of other financial collateral arrangements, if the nuclear damage liability insurance is required,
  • document on the approval of the physical protection assurance plan for the transport of nuclear materials of categories I to III,
  • document on the approval of emergency regulations for particular transport,
  • evidence of the arrangements ensuring that the radioactive material is taken back by the lkicensee in case of transit via the Czech Republic.

Transport Safety Case - Content

Annex 1 of Act No. 263/2016 Coll., Part 4 (Carriage of radioactive or fissile materials)

a) shipping instructions, complete with carriage specifications and the proposed route, including backup route,

b) radiation protection assurance programme, including the monitoring programme,   

c) physical protection assurance plan for the carriage of nuclear materials of categories I to III,  

d) radiation extraordinary event analysis and assessment for carriage,  

e) emergency regulations,

f) certificates for the service personnel of the means of transport to be used for carriage of dangerous goods that they have undergone training and passed examination on the specific requirements for carriage of dangerous goods under an international treaty binding on the Czech Republic30) or an equivalent certificate of competence for carriage of dangerous goods,  

g) certificate for the vehicle to be used for carriage of dangerous goods under the international treaty binding on the Czech Republic30) or an equivalent approval certificate for the vehicle to be used for carriage of dangerous goods,   

h) declaration of conformity of the materials, manufacturing processes and parameters and technical requirements placed on each packaging assembly with the data in the documentation used as a basis for the type-approval of the packaging assembly,  

i) management system programme,  

j) in the case of carriage of radioactive or fissile materials under special conditions, a list of the requirements under this Act or other legislation which cannot be satisfied, including justification, and a description of the special conditions for carriage replacing the conditions that cannot be satisfied, including evidence that equal or higher level of nuclear safety, radiation protection and physical protection will be ensured during carriage under special conditions,  

k) in the case of carriage of a radioactive or fissile material whose activity value has been calculated in order to determine the activity limits, the calculation of the activity value of the radioactive substance to determine the activity limits shall also be provided, including justification for not using the values set out in implementing legislation,  

l) in the case of carriage of radioactive substances contained in instruments or articles containing radionuclides, for which the exempt consignment values set out in implementing legislation were replaced with calculated values, the calculation of the individual doses to transport workers and representative persons and collective doses arising from routine, normal and accident conditions of transport, based on representative transport scenarios the consignments are subject to, in accordance with the principles and methodologies established by the International Atomic Energy Agency,  

m) in the case of carriage of radioactive substances as excepted fissile materials

  1. detailed description of the substance, with special emphasis on its physical and chemical status,
  2. evidence that the radioactive substances transported meet the exemption requirements set out in implementing legislation,
  3. description of the management system used and, where appropriate, special measures to be taken prior to carriage.

The documentation referred to in Points (c) and (e) shall be subject to approval by the Office.The documentation referred to in Point (g) shall be provided only if the international treaty binding on the Czech Republic requires such documentation for the carriage of radioactive or fissile materials to be licensed.

Content of Emergency Rules

The obligation to draw up emergency rules is laid down in Article 16 para 2 letter d) and Article 24 para 2 of Act No. 263/2016 Coll., Atomic Act, the obligation to have it approved by the SÚJB is laid down in Section 24 para 3 and in the Annex 1 to Act No. 263/2016 Coll., Part 4. on the transport of radioactive or fissile substances and the content of the emergency regulations is laid down in Annex 7 to Decree No 359/2016 Coll., on details to ensure the management of radiological emergencies. 

The emergency rules contain

a) introductory part, which contains

  1. details of the licence pursuant to Article 16(1) a) to e) and g) of the Atomic Act;
  2. name and surname of the person responsible for drawing up the emergency rules;
  3. communication connection details of the persons designated for response management;
  4. description of the material to be transported, cask and the mode of transport;

b) part concerning the performance of the licensed practice, which contains

  1. a list/description of radiation extraordinary event of first degree, radiation incident or radiation accident, which are considered in licensed practice, including ways of their detection;
  2. an overview of persons, who could be influenced by the radiation extraordinary event;

c) description of response preparedness, which contains

  1. description of technical and organisational arrangements intended to detect a radiation extraordinary event of first degree, radiation incident or radiation accident;
  2. description of technical and organisational arrangements intended to declare a radiation extraordinary event;
  3. description of technical and organisational arrangements intended for response management and implementation, including designation of persons involved in response management and implementation and a list of potential emergency workers and the way of their activation;
  4. description of technical and organisational arrangements intended to restrict accidental exposure;
  5. description of material and organisational arrangements intended to provide health matters;
  6. description of technical and organisational arrangements intended for response preparedness, and designation of the person responsible for checking of such arrangements;
  7. description of technical and organisational arrangements intended to verify the emergency rules and the intervention instruction, and designation of the person responsible for the verification;
  8. description of technical and organisational arrangements intended to verify the functionality of technical means, and designation of the person responsible for the verification;
  9. designation of the person responsible for terminating the response to radiation accident and initiating the remedial action after the radiation accident;
  10. a list of persons and authorities pursuant to Article 157(2) h) of the Atomic Act, including their communication details;
  11. designation of the person responsible for familiarisation pursuant to Article 156(1) b) and c) of the Atomic Act;

d) annexes as listed below

  1. a list of intervention instructions;
  2. notification form;
  3. information form.

The issue of a licence for the transport of radioactive or fissile substances is charged in accordance with the provisions of Act No. 634/2004 Coll. amounting to CZK 1,000.  

The fee for issuing a licence can be paid by stamp on the submitted application or by transfer to the CNB account number 3711-1824001/0710 (IBAN: CZ22 0710 0037 1100 0182 4001). It is recommended to use the applicant's identification number (ID) as a variable symbol.
